After reading the
complaint letter to Charnwood Borough Council do you think that the Council did send out a letter to the wrong address on the 9th February or do you think they said that they had sent the letter out to the wrong address simply to cover up the fact they had forgotten to deal with our barn application ?
Honestly- this is NIMBYISM. I could see an objection if this was an eyesore, a creaky corrugated blue or red tin hut construction which blighted the landscape.
But this barn is beautiful. You can see it actually enhancing the area and in years from now it will be a listed building and ironically protected by the council.
That goes without saying.
I would suggest that it is certainly very convenient for them that a letter exists, and that could have easily been created long after the original date had passed. But whethe the letter is genuine or not, the addess was wrong and you were never informed of any problem, so as a genuine letter confirms - you had every right to proceed.
Amd your barn looks fantastic, good use of traditional materials and inkeeping with the charm and character of the village, much better than a steel and concrete eyesore that you could have built - the views will be improved by leaving the barn there as if it comes down, any building that replaces it is going to have to be built on a tighter budget adn therefore will look much much worse.
As such it is in the locals best interests to keep it there, better the classic building that is there now than an ugly one that will enevitably replace it.
NIMBYism gone mad, and they will regret it if it means swapping a slate barn for a steel one.
come on, its charnwood borough council you are talking about. doesnt that explain everything ?

I dont think it matters if the letter was falsified or not. The authority gave consent for Mr White to build his barn. This is maladministration, plain and simple.
I believe there are political things going on that are not apparent at this time.

I tend to agree. If they faked the letter or not, it does not matter. It appears that approvals were given for the barn to be constructed so that is all that really matters. The key here is maladministration which seems quite obvious. It will be interesting to see if the complaints department of this regional council close ranks with the planning department to bury the facts or to come clean and admit to their maladministration. From my experience the council will have a policy not to admit liability under any circumstances. That is why the Local Authority Ombudsman will get involved to make an independent decision. Unfortunately it is rare for an Ombudsman to go against a local authority decision and in almost all cases they never offer compensation of more than a few thousand pounds. I note from reading the associated links that this council should have come to a conclusion on this maladministration case by now. What was the outcome ?

I agree. Although it appears to me to be plainly obvious that there has been some underhanded dealings by staff at Charnwood Borough Council I dont think this is the main issue. The thing that should be most worrying is that this local authority granted their approvals for this barn to be built not only on one occassion, but on two occassions. If they had any concerns about the designs that THEY HAD APPROVED then why didnt they stop the development before the foundations went in ? Instead it would appear that they watched the barn being built and then changed their minds once the building was nearly finished.
There is simply no logic to this at all. Is this local authority going to ge away with this ? It appears that there is one law for the people and one law fo the Council, or is it any law for the Council depending on how they feel ?
